Welcome to Moshita Inc., a fashion house specializing in limited-production prom and evening gowns. These Terms & Conditions (“Terms”) govern your access to and use of this website (the “Site”) and any purchase of products from Moshita Inc.

By accessing or using this Site, you agree to be bound by these Terms.

1. ELIGIBILITY

You must be at least eighteen (18) years of age or have parental or legal guardian consent to use this Site.

2. NATURE OF OUR GARMENTS

All garments are hand-finished, limited-production artistic creations.

Minor variations in fabric texture, color tone, bead placement, embroidery, and construction are inherent characteristics of couture craftsmanship and shall not be considered defects.

3. PRODUCT INFORMATION

We strive to display our products as accurately as possible. However, we do not guarantee that your monitor’s display of any color will be accurate.

All descriptions, pricing, and availability are subject to change without notice.

4. ORDERS & PAYMENTS

We reserve the right, in our sole discretion, to refuse or cancel any order at any time for any reason, including pricing errors, stock limitations, or suspected misuse.

All prices are listed in USD unless otherwise stated.

5. FINAL SALE, RETURNS & STORE CREDIT

Due to the exclusive, handcrafted nature of our collections:

Most items are FINAL SALE.

Any request for return must be submitted within fourteen (14) days of delivery and is subject to approval by Moshita Inc.

Any authorized return will be issued as store credit only, at the discretion of Moshita Inc.

Items showing signs of wear, alteration, scent, misuse, or damage may be refused.

6. INTELLECTUAL PROPERTY & DESIGN PROTECTION

All sketches, CADs, photography, concepts, garment designs, and all content on this Site are the exclusive intellectual property of Moshita Inc.

Unauthorized reproduction, scraping, AI training usage, or commercial exploitation is strictly prohibited.

7. USER CONDUCT & BRAND PROTECTION

You may not submit or publish false, misleading, defamatory, or harmful content regarding the brand. We reserve the right to pursue legal remedies for reputational harm.

8. USER SUBMISSIONS

By submitting any content, you grant Moshita Inc. a perpetual, royalty-free, irrevocable right to use such material in any form.

9. DISCLAIMER & LIMITATION OF LIABILITY

All products are provided “as is” and “as available.”

To the fullest extent permitted by law, Moshita Inc. shall not be liable for any indirect, incidental, special, or consequential damages.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Moshita Inc. from any claims arising out of your violation of these Terms.

11. TERMINATION

We reserve the right to terminate or restrict access to the Site at any time without notice.

12. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of the State of New Jersey, and all disputes shall be resolved by binding arbitration in that jurisdiction.

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of any updates.
